A company that goes by the name of retro games, have released a c64 mini, how is this legal? surely its against the law to create the same thing, call it the same thing and sell it?

The act of emulating a system is perfectly legal, which means building a handheld device or writing software that emulates a console is legal. Downloading ROMs you do not own, however, is certainly illegal.
